So, what can the homeowner do to get the funds?

If takes some pushing, but often we can get the county clerk to initiate what is called an Interpleader case. However, some counties refuse to initiate an Interpleader, and therefore the homeowner will have to initiate its own case via a declaratory action lawsuit.

Point being, if there are any lien holders that have failed to make a claim before the homeowner, the homeowner WILL have to go to court. Don’t delay. Get the case into court or nothing is going to happen with those surplus funds.
